To work as a private investigator in Spain, you must have completed the corresponding studies and be in possession of the updated TIP and be registered as practicing, verified by the private security unit of the Ministry of the Interior and you must meet the following requirements.

Requirements to practice as a Private Detective:

Private detectives in Barcelona must meet the following requirements required by the Ministry of the Interior

Have the nationality of any of the Member States of the European Union or of a State party to the Agreement on the European Economic Area, or be a national of a third State that has signed an international agreement with Spain in which each party recognizes access to the exercise of these activities to the nationals of the other.

1. Be of legal age.

2. Possess the physical capacity and psychological aptitude necessary for the exercise of the respective functions.

3. Be in possession of an official university degree in the field of private investigation that certifies the acquisition of the skills determined, or the title of the private investigation course, recognized by the Ministry of the Interior.

4. Lack of a criminal record for intentional crimes.

5. Not having been sanctioned in the previous two or four years for a serious or very serious infraction, respectively, in matters of private security.

6. Not having been separated from service in the Spanish Security Forces and Bodies or in the Spanish Armed Forces or in the country of their nationality or origin in the previous two years.

7. Not having been convicted of illegitimate interference in the field of protection of the right to honour, personal and family privacy or one’s own image, violation of the secrecy Communication or other fundamental rights within five years of the request.

8. Pass, where appropriate, the verification tests established by regulation by the Ministry of the Interior, which certify the knowledge and capacity necessary for the exercise of their functions.

HOW TO BECOME A GOOD DETECTIVE?

Basically, to be a good detective you must respect the ethical codes of any Private Detective Association or College,

The fundamental principles that must govern the professional practice of the Private Detective are the following:

Independence: 

The independence of the Private Detective in the exercise of his profession, that he must carry it out without being subjected to any pressure, mainly that which could come from his own interests or from external influences. It constitutes the guarantee that the client’s interests will be defended objectively.

Honesty:

The Private Detective in Barcelona must be morally upright, truthful, loyal and diligent in performing his duties.

Dignity:

We must act in accordance with the standards of honour and dignity of the profession.

Interest of the client:

The Private Detective must diligently attend to the interests of his client, for whom the appropriate measures will be taken to guarantee his legitimate interest.

Professional secrecy:

The Private Detective has the right and the duty to keep professional secrecy of all the facts and news that he knows by reason of his professional performance.

Incompatibilities:

The Private Detective must respect the regime of incompatibilities in force at all times for the exercise of the profession.

Veracity:

The veracity of the information provided by the Private Detective in his investigations towards his client and before the Administration of Justice protects his freedom of expression and the duty of ratification, which must be exercised responsibly.

The Private Detective will offer the client his knowledge, his experience and the necessary dedication for the proper performance of the matters entrusted to him, as well as the indications and advice that may be necessary for the best performance of the same.

The relationship of the Private Detective with the client, the company, must be based on mutual trust.

The Private Detective is free to accept or reject the matters entrusted to him, without the need to express the reasons for his decision.

The Private Detective must weigh the foreseeable result of the entrusted matter and its approximate cost and, when this is disproportionate with said foreseeable result, he must express his opinion to the client in this regard.

All Private Detectives must act with due professional competence and dedication to the entrusted matter and must not accept a greater number of assignments than those that they can duly attend to or that exceed the capacity, means and knowledge available to them.

The Private Detective is obliged to protect the interests of his client, looking after them to the extent that they do not oppose his professional duties.

The Private Detective must not accept matters with respect to which he maintains conflicting interests.

The Detective must not unfairly obtain clientele.

DETECTIVE PROFESSIONAL SECRET:

The Private Detective has the right and the obligation to keep professional secrecy regarding the facts of which he has knowledge by reason of any of the modalities of professional action.

Professional secrecy requires the Private Detective not to reveal facts, data, or information of a reserved or confidential nature, whether they come from his client, the investigated party or another colleague, which he has obtained by reason of the exercise of his profession within the framework of the law.

The Private Detective must enforce the professional secrecy of his staff and any person who collaborates with him in his professional activity.

The obligation to respect professional secrecy will continue even after the provision of services has ceased.

The investigator who obtains recordings or other means of evidence in the course of an investigation will also have the obligation to keep due secrecy. Such tests will be covered by professional secrecy and may not be made public under any circumstances that do not fall within the framework of the Law.

The Private Detective must refrain from giving anyone other than his client any type of verbal information, written report, or any evidence that he has obtained in the course of the investigation due to a professional matter, unless expressly authorized by him.
